These Terms and Conditions govern your access to and use of ABAIQ, including the website and Chrome extension, operated by Hybreu Digital LLC. By accessing or using the Service, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Service.
1. Description of the Service
ABAIQ is a productivity and drafting assistance tool designed to help users generate draft content based on information provided by the user or visible during use. The Service operates solely as an assistive tool and does not replace professional judgment, clinical decision-making, or documentation responsibilities. All content generation occurs only at the user’s request and under the user’s control. ABAIQ does not function as an electronic health record system, does not act as a system of record, and does not store, manage, or retain clinical records or protected health information.
2. Eligibility and Accounts
You must be at least 18 years old to use ABAIQ. By creating an account, you represent that you are legally capable of entering into a binding agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. ABAIQ is not responsible for unauthorized access resulting from your failure to safeguard your credentials.
3. User Responsibilities
You are solely responsible for how you use the Service and for any information you choose to input, generate, copy, store, or submit using ABAIQ. You represent and warrant that you have the legal right to use any information you input into the Service, including any sensitive, clinical, or personal information. You acknowledge that all drafts generated by ABAIQ require your independent review, modification, and approval before use. ABAIQ does not guarantee that generated content will be accurate, complete, or compliant with any legal, clinical, regulatory, or professional standards.
4. Use of Artificial Intelligence
ABAIQ uses artificial intelligence solely to generate draft content requested by the user. Processing occurs temporarily and in real time for the sole purpose of producing the requested output. ABAIQ does not retain, store, reuse, or learn from user inputs or generated drafts after processing is complete. You acknowledge that artificial intelligence–generated content may contain errors, omissions, or inaccuracies and must not be relied upon as final or authoritative without independent review. ABAIQ does not make decisions, recommendations, or determinations on behalf of the user.
5. Subscriptions and Payments
Access to certain features of ABAIQ may require a paid subscription. Subscription fees, billing cycles, and usage limits are displayed at the time of purchase. Payments are processed through third-party payment processors. ABAIQ does not store full payment credentials. Subscriptions renew automatically unless canceled prior to the renewal date. You are responsible for managing your subscription and canceling it if you no longer wish to continue. Fees are non-refundable except where required by law.
6. Acceptable Use
You agree not to misuse the Service, interfere with its operation, attempt to gain unauthorized access, reverse engineer the Service, or use ABAIQ in violation of any applicable laws or regulations. ABAIQ reserves the right to suspend or terminate access if the Service is used in a manner that violates these Terms or poses a risk to the Service or other users.
7. Intellectual Property
All rights, title, and interest in ABAIQ, including the website, extension, software, branding, and content, are owned by Hybreu Digital LLC or its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service solely for your personal or professional purposes. You retain ownership of the content you create using the Service.
8. Third-Party Services
ABAIQ may integrate with or reference third-party services. ABAIQ is not responsible for the content, policies, or practices of third-party platforms. Your use of third-party services is governed by their respective terms and policies.
9. Disclaimer of Warranties
The Service is provided on an as-is and as-available basis. ABAIQ makes no warranties of any kind, express or implied, regarding the accuracy, reliability, availability, or suitability of the Service for any particular purpose. ABAIQ does not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
10. Limitation of Liability
To the maximum extent permitted by law, Hybreu Digital LLC shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Service. ABAIQ’s total liability for any claim arising under these Terms shall not exceed the amount you paid to use the Service during the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Hybreu Digital LLC from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your misuse of generated content.
12. Termination
You may stop using ABAIQ at any time. ABAIQ may suspend or terminate access to the Service at its discretion if these Terms are violated or if continued access poses legal or operational risk. Upon termination, your right to use the Service will immediately cease.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the United States and the State in which Hybreu Digital LLC is registered, without regard to conflict of law principles.
14. Changes to These Terms
ABAIQ may update these Terms and Conditions from time to time. Updated terms will be posted on this page with a revised last updated date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
